Terms of Service

Please read these Terms of Service ("Terms") carefully before using the FoodsPlans application ("the App", "we", "us"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement. If you are under the age of legal majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To use the App, you must create an account using Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information during registration and to update it as necessary.

3. Description of the App

FoodsPlans is a meal planning tool that allows you to create meals, organize them into categories, build weekly meal plans, and generate grocery lists. The App is available for download on the Apple App Store and Google Play Store.

The App offers the following functionality: creating and managing meals with custom names and photos, organizing meals into categories, building weekly meal plans, AI-powered grocery list generation based on your meal plans, AI-powered image generation for meals, and sharing lists with other users via unique codes.

The App is a planning tool only. It does not provide dietary, medical, nutritional, or health advice of any kind.

4. Free and Premium Plans

The App can be used free of charge with the following limitations: up to 21 meals, up to 2 weeks in the planner, and up to 2 AI-generated grocery lists per month (non-editable).

The Premium plan removes most limitations and provides: up to 400 meals, up to 50 weeks in the planner, and up to 20 AI-generated grocery lists per month (editable).

The App does not contain any advertising. There are no free trial periods. You may use the free version indefinitely or upgrade to Premium at any time.

5. Subscriptions and Payments

Premium subscriptions are processed exclusively through Apple App Store or Google Play Billing. We do not collect or store your payment information. All purchases are subject to the terms and refund policies of the respective platform: Apple App Store and Google Play.

You may cancel your subscription at any time through your device's subscription settings. Upon cancellation, you retain Premium access until the end of the current billing period.

6. AI-Powered Features

The App uses third-party artificial intelligence services (including Anthropic's Claude API and other providers) to generate grocery lists and meal images. You acknowledge and agree that: AI-generated content may not always be accurate, complete, or suitable for your needs; AI-generated grocery lists are suggestions and should be reviewed before use; AI-generated images are created based on meal names you provide and may not perfectly represent the intended dish; availability and quality of AI features may vary and depend on third-party service providers.

We do not guarantee the accuracy, reliability, or availability of any AI-powered features.

7. AI-Generated Content Ownership

You retain ownership of AI-generated images and grocery lists created through your use of the App. You are free to use, share, or modify this content as you see fit. However, we make no representations or warranties regarding the intellectual property status of AI-generated content under applicable law, as this area of law is evolving. You use AI-generated content at your own risk.

8. User Content

You retain ownership of all content you create or upload in the App, including meal names, descriptions, photos, lists, and plans ("User Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the App's functionality.

You are solely responsible for the User Content you create, upload, or share through the App. We do not monitor, review, endorse, or assume any responsibility for User Content. We reserve the right to remove content that violates applicable law or these Terms.

The App allows you to share your lists with other users by generating a unique code. When you share a code, other users may subscribe to your list or copy it. You are solely responsible for deciding whom to share your code with. We are not responsible for how recipients use the shared content.

If you subscribe to or copy another user's list, you acknowledge that the content was created by that user and we bear no responsibility for its accuracy or appropriateness.

10. Photo Access

The App may request permission to access your device's photo gallery to allow you to upload images for your meals. This permission is optional and can be revoked at any time through your device settings. We only access photos that you explicitly select for upload.

11. Prohibited Uses

You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to the App's systems or other users' accounts; reverse-engineer, decompile, or disassemble the App; use automated tools (bots, scrapers) to access the App; interfere with or disrupt the App's operation or servers; impersonate another person or entity; or use the App to distribute spam, malware, or harmful content.

12. Intellectual Property

The App, including its design, code, features, branding, and all related intellectual property, is owned by FoodsPlans and protected by applicable copyright and intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOODSPLANS AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

15. Account Termination

You may delete your account at any time directly within the App. Upon deletion, all your personal data will be permanently removed from our servers within 30 days.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or applicable law. We will make reasonable efforts to notify you before or promptly after any such action.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine. Any disputes arising out of or related to these Terms shall be resolved in the courts of Ukraine, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

17. Dispute Resolution (United States Users)

If you are located in the United States, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Each party may bring claims against the other only in their individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

18. Indemnification

You agree to indemnify, defend, and hold harmless FoodsPlans and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you should stop using the App and delete your account.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
